These Terms & Conditions ("Terms") govern the provision of professional beauty, aesthetics and wellness services, the sale of retail products, and the use of our website and online store by Refinement Clinic (Pty) Ltd ("Refinement Clinic", "we", "us", "our").

By making a booking, purchasing a product, visiting our premises, using our website, or otherwise engaging with our services, you agree to be bound by these Terms as well as any policies referenced herein.

If you do not agree with these Terms, please refrain from using our services or website.

2. Scope of Services

Refinement Clinic provides professional beauty, aesthetics and wellness treatments, delivered by qualified, trained and registered Somatologists and technicians in accordance with professional standards and applicable South African legislation.

Our services include (but are not limited to):

Skin Treatments

• Facials
• Chemical peels
• Microdermabrasion
• Microneedling
• Collagen stimulation treatments

Hair Removal

• Laser hair removal
• IPL treatments
• Professional waxing

Body Treatments

• Body contouring
• Cellulite treatments
• Detox treatments
• Massage therapy

Beauty & Grooming

• Manicures and pedicures
• Nail enhancements
• Brow shaping and tinting
• Lash lifts and tinting

All procedures are performed in accordance with:

• Manufacturer guidelines
• Evidence-based practice
• Occupational health and safety standards
• Applicable municipal and national regulations

Important:
Our treatments are cosmetic and non-medical. If you have a medical condition or concern, you should consult a qualified medical practitioner before undergoing any treatment.


3. Bookings & Appointment Policy

3.1 Booking Confirmation

Appointments are confirmed once you receive a booking confirmation via SMS, email or online booking system.

3.2 Cancellations & Rescheduling

Appointments may be cancelled or rescheduled up to 2 hours before the scheduled time without penalty.

3.3 Late Cancellations & No-Shows

If you cancel within 2 hours of the appointment or fail to attend your appointment, it will be recorded as a no-show.

3.4 Deposits

Clients who miss an appointment may be required to pay a R250 deposit or full pre-payment for future bookings.

Deposits:

• are deducted from the treatment price
• are forfeited if the appointment is missed
• may be transferred if rescheduled with sufficient notice

3.5 Grace Period

We allow a 10-minute grace period for appointments.

Arriving more than 10 minutes late may:

• reduce treatment time, or
• result in cancellation of the appointment.

Our cancellation policy complies with the Consumer Protection Act (CPA) 68 of 2008 regarding reasonable cancellation penalties.


4. Pricing & Payments

All prices are quoted in South African Rand (ZAR) and include 15% VAT unless otherwise indicated.

We accept:

• Cash
• EFT
• Debit & Credit Cards
• Approved digital payment methods

Payment for services is due immediately after the treatment unless prepaid.

Promotions, loyalty points, vouchers and discounts:

• may not be exchanged for cash
• may have additional terms and conditions.

Prices may change without prior notice.


5. Client Responsibilities & Medical Disclosure

Accurate Information

Clients must disclose any relevant:

• medical conditions
• allergies
• medications
• pregnancy status
• skin sensitivities
• recent treatments

Failure to disclose relevant information may affect treatment safety.

After-Care

Clients must follow all after-care instructions provided.

Failure to follow after-care instructions may:

• affect treatment results
• increase the risk of complications
• limit our ability to assist with concerns.

Age Restrictions

Clients under 18 years of age require parental or guardian consent and may need to be accompanied during certain treatments.


6. Professional Conduct & Safety

We maintain a zero-tolerance policy toward harassment, intimidation or inappropriate conduct.

Any client who displays:

• abusive behaviour
• threatening conduct
• sexual harassment
• intimidation

may be:

• refused service
• asked to leave the premises
• banned from future bookings

Unlawful behaviour may be reported to the South African Police Service (SAPS).


7. Treatment Risks & Liability

While all reasonable care is taken, cosmetic treatments carry inherent risks.

By undergoing treatment, you acknowledge and accept that:

• results may vary between individuals
• some treatments may cause temporary redness, irritation or sensitivity
• allergic reactions to products may occur.

Refinement Clinic and its employees shall not be liable for damages arising from:

• failure to disclose medical information
• failure to follow after-care instructions
• allergic reactions
• unforeseeable skin responses
• events beyond our reasonable control.

Where permitted by law, our maximum liability shall not exceed the amount paid for the treatment in question.

Nothing in this clause limits rights provided under the Consumer Protection Act (CPA).


8. Retail Products & Online Purchases

Retail products sold through the clinic or website are subject to the Consumer Protection Act (CPA).

Returns may be accepted if:

• the product is defective
• the product was incorrectly supplied.

For hygiene reasons:

opened or used cosmetic products cannot be returned unless defective.

Online orders may also be subject to separate Shipping and Refund Policies available on our website.


9. Website Use & Intellectual Property

All content on our website including:

• logos
• text
• images
• treatment descriptions
• marketing materials

are the property of Refinement Clinic or its licensors and are protected by intellectual property laws.

You may not reproduce, distribute or use our content without written permission.


10. Relationship With Shopify

Our online store is powered by Shopify, which provides the e-commerce platform allowing us to sell products and services online.

Any purchases made on our website are transactions directly between you and Refinement Clinic.

Shopify is not responsible for:

• the products sold
• treatment services
• customer disputes.


11. Privacy & POPIA Compliance

Refinement Clinic processes personal information in accordance with the Protection of Personal Information Act (POPIA) 4 of 2013.

Personal information collected may include:

• contact details
• booking information
• purchase history

Information is used solely for:

• service delivery
• communication
• regulatory compliance.

12. Gift Vouchers & Promotions

Gift vouchers:

• are valid for 12 months from the date of purchase
• cannot be exchanged for cash
• may not be replaced if lost or stolen.

Promotional offers may be subject to additional conditions.


13. Force Majeure

Refinement Clinic will not be liable for failure or delay in providing services due to events beyond our control, including:

• load-shedding
• pandemics
• natural disasters
• government restrictions
• internet or power outages.


14. Governing Law

These Terms are governed by the laws of the Republic of South Africa.

Any disputes arising from these Terms shall fall under the jurisdiction of the courts of South Africa.


15. Amendments to Terms

We reserve the right to update these Terms at any time.

Changes will be published on our website with an updated “Last Updated” date.

Continued use of our services constitutes acceptance of the revised Terms.
